These sales conditions aim to define the contractual relationships applicable to any purchase made on the online sales site "Dzigana." Dzigana reserves the right to modify them at any time. In this case, the buyer will refer to those in force at the time of the order. Placing an order implies that the buyer has read and accepted the sales conditions in effect. Prices are expressed in euros and are inclusive of all taxes, excluding shipping fees, which will be indicated during the ordering process and added to the product prices. Dzigana reserves the right to modify them at any time, provided that the price charged to the buyer is the one in effect at the time of the order.Product AvailabilityDzigana strives to ensure product availability. This is indicated on the site for each product. However, in the event of an error or the exceptional case where a product is unavailable after the order has been placed, Dzigana will inform the buyer as soon as possible of the necessary delivery time. The buyer may then request the cancellation of the order, and it will be refunded if payment has already been made.
The order is considered accepted by Dzigana upon receipt of full payment (including delivery fees corresponding to the delivery zone, see below). Dzigana reserves the right to refuse an order in the event of a dispute with the buyer regarding a previous order or doubts about the buyer's seriousness (e.g., delivery to a foreign PO box).Delivery TermsProducts will be delivered to the address provided by the buyer on the order form. The address considered will be that of the buyer unless the buyer has specifically indicated a different delivery address. Delivery fees are indicated during the ordering process. For deliveries outside mainland France, the buyer agrees to comply with the laws regarding the importation of goods into the destination country.The order is processed as quickly as possible, generally within two or three working days, except in cases of exceptional closures, where deliveries will be delayed, in which case a notice will be posted on the site. Dzigana will notify the client by email when the order is shipped and provide a tracking code for the package on the La Poste website.
It is the client's responsibility to check the condition of the package upon delivery. Any reservations (open or damaged package, etc.) must be noted on the delivery slip, accompanied by the client's signature. If damage to the goods is discovered, the client must file a claim with La Poste by registered letter and send a copy of it to Dzigana. Failure to note any reservations upon receipt does not deprive you of the legal guarantee of conformity inherent in the product (see below).
You have the right to withdraw without giving any reason within 14 days. The withdrawal period expires 14 days after the day you, or a third party other than the carrier and indicated by you, physically take possession of the last item of the order. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract through a clear statement (for example, a message via the contact form or a letter sent by post to Dzigana, 1 rue Casimir Mouton 13640 La Roque d'Anthéron, or by email to dzigana.creations@gmail.com). To meet the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the withdrawal period has expired. If you withdraw, we will refund all payments received from you, including delivery costs (except for any additional costs, in case you chose a delivery method other than the least expensive standard delivery method offered by us) without undue delay and, in any case, upon receipt of the returned goods. We will proceed with the refund using the same means of payment that you used for the initial transaction unless you expressly agree otherwise; in any case, this refund will not incur any fees for you. You must return the items to Dzigana, 1 rue Casimir Mouton, 13640 La Roque d'Anthéron, without undue delay and, in any case, no later than fourteen days after you communicated your decision to withdraw. This deadline is considered met if you return the goods before the fourteen-day period has expired. You will bear the direct costs of returning the items. Warranty We guarantee our jewelry against any lack of conformity under the conditions of Article L.217-4 and following of the French Consumer Code and against any hidden defects under the conditions provided in Articles 1641 and following of the French Civil Code. (See box below). Any request regarding this matter can be addressed to SAS HB, 1 rue Casimir Mouton, 13640 LA ROQUE D'ANTHERON, as the guarantor of the conformity of its jewelry.
Legal Warranty of Conformity
The seller is responsible for defects in the conformity of goods under the conditions of Article L.217-4 and following of the French Consumer Code and hidden defects in the goods under the conditions provided in Articles 1641 and following of the French Civil Code. By acting under the legal warranty of conformity, the buyer: - has a period of 2 years from the delivery of the goods to act; - can choose between repairing or replacing the goods, subject to the cost conditions provided for in Article L.217-9 of the French Consumer Code. - is exempt from proving the existence of the lack of conformity of the goods within the twenty-four months following the delivery of the goods, except for second-hand goods. - may decide to enforce the warranty against hidden defects of the item sold as per Article 1641 of the French Civil Code and, in this case, may choose between canceling the sale or reducing the sale price in accordance with Article 1644 of the French Civil Code. The legal warranty of conformity applies independently of any commercial warranty that may have been granted. |
Sales concluded with SAS HB (Dzigana) or via the website dzigana.com are subject to French law. In case of a dispute, an amicable solution will be sought before any legal action is taken. To this end, and in accordance with the law, we are affiliated with an accredited mediation center.
